(Application no. 18788/22)

JUDGMENT

Art 6 (civil) • Access to court • Impossibility of obtaining judicial review of the mayoral decision issued in a public tender procedure for the lease of municipal property in which the applicant participated as a bidder • Art 6 applicable • Genuine and serious dispute over civil “right” in domestic law of bidders to compete on equal terms in the tender procedure • High Administrative Court’s decision, declaring inadmissible the applicant’s action on the ground that the mayoral decision was not an administrative act amenable to judicial review, based on a temporary change of approach by the domestic courts at the time without any detailed explanation • Judicial review of compliance by municipalities with their statutory obligations to organise public tenders and award contracts ensures the lawfulness of the procedure and guarantees accountability • Very essence of right of access to a court impaired

Prepared by the Registry. Does not bind the Court.
